NGL Labs LLC (“NGL,” “we,” “us,” or “our”) provides this notice to tell you what personal information we collect, why we collect it, and whether we sell or share it, at or before the time we collect it. It applies to personal information we collect through the NGL app, our website (https://ngl.link/ and https://nglapp.com), and any other sites or services we operate (the “Services”), including from NGL Pro subscribers, website visitors, and people who send messages through an NGL link. NGL is part of the family of products operated by Mode Mobile, Inc. (“Mode”). For full details, please read our Privacy Policy.
Personal information we collect and how we use it
Identifiers
Examples: Username; email address (including one provided by Smart Recognition or that you send us when you contact us); IP address; device identifiers, which may include advertising identifiers.
Why we collect and use it: To create your account and provide the Services; for customer support; to keep the Services secure and prevent fraud; to market the Services, including by email.
Sold or shared?: Yes. Smart Recognition and Rokt (see below). Mode and its program partners only if you opt in to a program.
Identifiers and online activity obtained through Smart Recognition
Examples: Email address; browser and device identifiers; your activity on our website; approximate location.
Why we collect and use it: To market the Services, including by email, and to increase the value of advertising delivered through or in connection with the Services. We do not use this information to create or manage your account.
Sold or shared?: Yes. Smart Recognition
Commercial information
Examples: Records of NGL Pro subscriptions and other in-app purchases.
Why we collect and use it: To process and support your purchases and provide Pro features; to select and present offers (see Rokt below).
Sold or shared?: Yes. Rokt.
Internet or other network activity
Examples: How you use the Services and interact with us; pages or screens viewed, time spent, browsing history, navigation paths, and access times; device data such as operating system, browser, device type, and mobile carrier.
Why we collect and use it: To provide, personalize, troubleshoot, secure, and improve the Services; for analytics; to market the Services; to give NGL Pro subscribers information about Message Senders.
Sold or shared?: Yes. Smart Recognition and Rokt. Mode and its program partners only if you opt in.
Geolocation data
Examples: Approximate location based on your IP address, such as city, state, or geographic area.
Why we collect and use it: To give NGL Pro subscribers information about Message Senders; to market the Services.
Sold or shared?: Yes. Smart Recognition and Rokt. Mode and its program partners only if you opt in.
Visual information
Examples: Profile picture you upload.
Why we collect and use it: To provide the Services.
Sold or shared?: No.
Sensitive personal information
Examples: Account access credentials, such as your username; the contents of messages sent through the Services.
Why we collect and use it: To provide the Services, including content moderation and safety. We use sensitive personal information only for purposes permitted by the CCPA.
Sold or shared?: No.
Date of birth
Examples: Month and year of birth, where we ask for it.
Why we collect and use it: To determine your eligibility to use the NGL app.
Sold or shared?: No.
Information you choose to share through optional rewards or data-sharing programs
Examples: App usage, browsing, or location data that you elect to share.
Why we collect and use it: To operate NGL’s and Mode’s optional data-sharing and rewards programs, which may include sharing the data with Mode’s program partners in exchange for points, cash, or other compensation to you.
Sold or shared?: Maybe. Only if you opt in, and you can withdraw at any time.
Feedback and correspondence
Examples: Information you provide when you contact us with questions, feedback, or reviews.
Why we collect and use it: To provide customer support, respond to requests, and improve the Services.
Sold or shared?: No.
Where we get your information
From you, when you create an account, upload a profile picture, send or receive messages, make a purchase, contact us, or choose to join an optional rewards or data-sharing program.
Automatically, through cookies, local storage, web beacons or pixels, and device fingerprinting when you use the Services.
From other sources, including marketing providers (such as ad impressions, clicks, and app installs) and, when you visit certain pages of our website, our identity resolution provider, Smart Recognition, which may give us an email address it associates with your browser or device. We use that email address for marketing and advertising purposes, not to create or manage your account.
If you send a message through an NGL link: we do not store your name or social media handle. We do collect device and approximate location information, and we may share certain information about you, such as approximate location, device type, and carrier, with NGL Pro subscribers who receive your message.
Third parties that collect information through our Services
Smart Recognition. On certain pages of our website, a pixel operated by Smart Recognition, a third-party identity resolution service, collects information about your browser, device, and online activity, including through device fingerprinting. It matches that information against its own data to identify an email address associated with you and gives that email address to us. We do not use information from Smart Recognition to create or manage accounts or to provide the Services. We use it to market the Services to you, including by email, and to increase the value of advertising delivered through or in connection with the Services, for example by recognizing website visitors, building audiences, and selecting and measuring ads. Rokt Inc. We work with Rokt to present offers from its network of advertisers within the Services, for example after a purchase. When an offer placement loads, we disclose information to Rokt that may include your email address, device identifiers, IP address, approximate location, and information about your transaction. If you engage with an offer, Rokt and the advertiser may collect and use your information under their own terms and privacy policies, including Rokt’s privacy policy. We do not knowingly disclose to Rokt the personal information of individuals under 18.
Analytics providers, such as Google Analytics, which help us understand how the Services are used.
Do we sell or share your personal information?
In limited ways, yes. Our use of Smart Recognition on our website and our disclosures to Rokt may be a “sale” or “sharing” of personal information under the CCPA/CPRA and similar state privacy laws. So may the data you choose to share with Mode and its program partners through optional rewards or data-sharing programs. Because we use Smart Recognition in part for advertising purposes, this use may be “sharing” of personal information for cross-context behavioral advertising, in addition to a possible “sale.” We do not sell or share the personal information of consumers we know to be under 16 years of age.
You can opt out at any time. See our Notice of Right to Opt Out of Sale/Sharing at the bottom of our website. We also honor opt-out preference signals such as Global Privacy Control.
How long we keep your personal information
We keep your personal information only as long as is reasonably necessary for the purposes described above and as required by law, or until you withdraw your consent where applicable. To decide how long to keep it, we consider the amount, nature, and sensitivity of the information, the risk of harm from unauthorized use or disclosure, the purposes for which we use it and whether we can achieve them by other means, and legal requirements.
Individuals under 18
Our Services are not intended for individuals under 18 years of age, and we do not seek or knowingly collect personal information about them. See Section 5 of our Privacy Policy.
Your choices and contact information
Depending on where you live, you may have rights to access, correct, delete, and opt out of the sale or sharing of your personal information. These rights and how to use them are described in our Privacy Policy.
